[2026:RJ-JP:5607] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 93/2026 Ravi Sain S/o Shyam Prakash, Aged About 19 Years, R/o Ganesh Vatika, Chauthkabarwada Road, Dhamunkhurd, Police Station Mantown, District Sawaimadhopur. (Presently Accused Confined In Central Jail Sawaimadhopur). ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor ----Respondent For Petitioner(s) : Mr. Rahul Agrawal For Respondent(s) : Mr. Rhishiraj Singh Rathore, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 06/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No.438/2025 registered at Police Station Mantown, District Sawai Madhopur for offence(s) under Section(s) 318(4), 319(2) of B.N.S. and Section 66D of IT Act. 2. Learned counsel for the petitioner submits that the accused- petitioner is an innocent person and has been falsely implicated in this case. Learned counsel further submits that petitioner has no nexus with the alleged offences and no act of cyber fraud has been committed by him. Learned counsel also submits that petitioner has no criminal antecedent and the alleged offences are triable by Magistrate. He further submits that petitioner is in custody since long; charge-sheet has already been filed in the matter and no recovery is required to be made from him. Counsel also submits that trial will take considerable long time in its conclusion, so no fruitful purpose would be served by [2026:RJ-JP:5607] (2 of 2) [CRLMB-93/2026] keeping the petitioner into custody, therefore, petitioner may be enlarged on bail. 3. Per contra, learned Public Prosecutor opposes the bail application. 4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that the offences are triable by Magistrate, petitioner has no criminal antecedent and charge-sheet has already been filed, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, this bail application is allowed and accused-petitioner Ravi Sain S/o Shyam Prakash is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Trial Court, with the following conditions:- (i) The accused-petitioner shall not tamper with evidence or influence the witness in any manner. (ii) The accused-petitioner shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law. (iii) The accused-petitioner shall attend the hearing of the Trial Court on the date fixed by the Trial Court or as and when asked to appear before the Trial Court. (iv) In case of any violation of above conditions, the bail granted to the accused-petitioner shall be liable to be cancelled. (SANDEEP TANEJA,J TN/117
