Page No.# 2/3 BEFORE HONOURABLE MR. JUSTICE ROBIN PHUKAN ORDER 22.09.2026 Heard Mr. B. Islam, learned counsel for the accused and Mr. B. Sarma, learned Additional Public Prosecutor for the State respondent. This application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is preferred by the accused, namely, Sri Arindam Ganguly and Sri Benu Chakraborty, who have been languishing in jail hajot in connection with Namtola P.S. Case No. 15/2026, under Sections 319(2)/318(4)/336(3)/338/125(a)/3(5) of BNS, 2023, read with Section 28 of the Assam Medical Council Act, 1999, corresponding to G.R. Case No. 177/2026, for grant of bail. Mr. Sarma, learned APP, submits that he has not received the case diary and as per his instruction, the I.O. has completed investigation and submitted charge-sheet, being charge-sheet No. 14/2026, dated 26.08.2026. The learned counsel for the accused submits the petitioner will apply for regular bail before the learned Trial Court and as such, this application may be closed. Accordingly, taking note of the submission of the learned counsel for the accused, this bail application stands closed. However, liberty is given to the applicant to approach the learned Trial Court
Page No.# 3/3 and apply for regular bail. And in the event of filing such an application, the learned Trial Court shall consider the same in accordance with law.
