For the Private Respondent no. 7 Report has been submitted by the State on the earlier occasion. Alleging unauthorised construction raised by the private respondents without obtaining sanctioned plan and permission from the Panchayat and in contravention of the building Rules, the petitioner submitted a representation before the concerned authority on 20th January, 2026 which is yet to be considered. The petitioner seeks consideration of the same. Opposing such allegation, learned counsel for the private respondents submits that the said construction has been raised before 2020. Be that as it may, since the representation submitted by the petitioner before the concerned authority is pending, the Pradhan, Salap No. 1 Gram Panchayat being the 5th respondent herein, is directed 2 to consider and dispose of the same within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is accordingly disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
