Shahid, who is in custody in connection with Pachamba (Giridih) P.S. Case No.130 of 2023 for the offence registered under Sections 147 / 148/ 341/ 323/ 324/ 325/ 307/ 354(A) / 354(D)/ 379 / 452 / 506/ 509 of the IPC and under Section 8 of the POCSO Act has prayed for regular bail. As per the prosecution case, the prosecutrix was used to be stopped on the way by the petitioner and one Md. Dilshad and they used to pass comments and unseeming gestures amounting to sexual harassment. When the same was opposed on 10.10.2023, they assaulted her and her family members. It is submitted by the learned counsel on behalf of petitioner that the injury sustained is simple in nature, therefore, the offence under Section 307 IPC will not be made out and charge-sheet has also not been filed under this Section. The maximum sentence under Section 354A IPC is of three years. He is in custody since 15.07.2025. Charge has already been framed in this case and the accused persons are facing trial. Learned A.P.P. opposed the prayer for bail. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
