ORDER(ORAL):05.05.2026
01. 1. These matters are taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Bari Ramachandrapur PS Case No.106 of 2026 corresponding to CT Case No.102 of 2026 pending in the file of learned JMFC, Baripal, for commission of offences punishable U/Ss.310(4)/310(5) of BNS, on the main allegation of congregating in an isolated place, along with co-accused persons being armed with deadly weapons and preparing to commit dacoity. 4. Heard, Mr. Balaram Nayak, learned counsel for the petitioners in BLAPL No.3356 of 2026, Mr. Amlan p. 2 Mohanty, learned counsel for the petitioner in BLAPL No.3702 of 2026 and Mr. M.R. Patra, learned Additional Public Prosecutor in these matters and perused the record. On being queried about the criminal antecedents of the petitioners, Mr. Nayak and Mr. Mohanty jointly volunteer to withhold bail to the petitioners, if he/they is/are found to have any criminal antecedent. 5. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 17.03.2026 with substantial progress in investigation and taking into account the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and there being no materials collected by the investigating agency to suggest that the petitioners would abscond or would pose threat to the witnesses, if released on bail, this Court without expressing any view on merits admits each of the petitioners to bail, but subject to verification of their criminal antecedents. 6.
6. Hence, these two bail applications of the petitioners namely Sanjit Das and Arjun Das (In BLAPL No.3356 of 2026) and Kushan Samal (In BLAPL No.3702 of 2026) are allowed and each of the p. 3 petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. In view of the specific submission as advanced for the petitioners, the benefit of the aforesaid order shall not be extended to the concerned petitioner(s), if he/they is/are found to have any criminal antecedent(s). 7. Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference. (G. Satapathy)
