Case No. 210 of 2025 for the offence registered under Section 109 of Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act pending in the Court of learned Chief Judicial Magistrate, Godda, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that as per the FIR, there was an accidental firing in the procession being taken for immersion of idol of Goddess Kali. The act being accidental, the offence under Section 109 of the BNS will not be made out. Learned A.P.P. opposed the bail petition, but has not disputed the factual assertions. Under the aforesaid facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
