------- 12/Dated:12.03.2026
1.
From the averments made in supplementary show cause as well as rejoinder it appears that though the petitioners were paid salary @ Rs.2200/- with other usual allowance from November, 2005 to 03.05.2011 but from 04.05.2012 they were paid minimum of pay scale of Lecturer till July 2017. However, from perusal of the
order it appears that Coordinate Bench of this Court had categorically directed that till the regular appointments are made the petitioners shall not be removed from their post and if disengaged by virtue of order dated 04.05.2012, they shall be continued in service.
2.
In other words, from bare perusal of paragraph no.17 of the order under compliance as a whole it clearly transpires that the Coordinate Bench has directed to pay the minimum pay scale of Lecturer to the petitioners till the appointment of new Lecturers.
3.
It has been informed by the learned counsel for the University that process of new appointment has been made; meaning thereby to say that appointment has not been made till date; therefore the grievance of the petitioners that only till July, 2017 they have got the salary of minimum pay scale of Lecturer but thereafter it

has been stopped does not appears to be true compliance of the order passed by the Coordinate Bench.
4.
Learned counsel for the respondent draws attention of this Court towards the decision of the Committee which is annexed with the rejoinder affidavit and submits that strictly in compliance of the Coordinate Bench’s order, this order has been passed.
5.
Mr. Mukhtar Khan learned counsel for the petitioners submits that the petitioners are not aggrieved by this decision dated 12.08.2024 but unfortunately, the amount has not yet been paid to the petitioners and direction nos. C & D has not been complied.
6.
Learned counsel for the University submits that they have paid the entire amount as per the report of the Committee dated 12/8/2024. However, if at all there would be any calculation error, the respondents are ready to recalculate the same.
7.
As stated hereinabove,
learned counsel appearing on behalf of all the petitioners has fairly submitted that the petitioners are not aggrieved by the decision taken by the committee on 12-8-20-24 in 3rd paragraph. However, they are only aggrieved with calculation of the amount, because as per them, the direction given by the committee in para 3 (C) & (D) has not been complied.
8.
Having regard to the aforesaid facts and circumstances of the case, all these contempt applications are hereby disposed of with a direction to the respondent No.2, who shall look into the matter and see as to whether 3rd paragraph of the committee report has been complied in view of the fact that the same is in conformity and in full compliance of the coordinate Bench’s order.

9.
One of the petitioners is directed to approach the concerned respondent i.e. respondent no.2 along with their own calculation chart, vis-a-vis the chart prepared by the university and point out the infirmity and the respondent no.2 after going through the objection raised by these petitioners shall verify the records of the case and if any amount still remains to be paid, the same shall be paid within a period of eight weeks from the date of receipt of a copy of this order.
10. It goes without saying that if the petitioners would be aggrieved by the calculation, they would be at liberty to raise their grievance, if so advised.
11. Accordingly, all these applications stand
disposed of.
