CRP No. 2743 of 2026 __________ Page2 of 4 ORDER The petitioner is the defendant in IA.No.11 of 2026 in I.A.No.3 of 2025 in OS.No.66 of 2025 on the file of the learned Additional District Munsif Court, Poonamallee. 2. The suit has been filed by the respondent /plaintiff based solely on an unregistered agreement of sale dated 19.03.2012. The petitioner has specifically disputed the genuineness of the signature of the alleged executants found in the said agreement and in order to establish the same, has taken steps to subject the disputed document to forensic examination. The document was already examined by a government –recognized private forensic laboratory, which opined that the specimen signatures and the questioned signatures are not similar. 3. In view of the same the petitioner filed I.A.No. 1 of 2026 seeking appropriate orders pending receipt of the report from the Government Forensic Laboratory, as the expert opinion would go to the very root of the matter and have a direct bearing on the adjudication of the suit. However without awaiting the said report, the trial court is proceeding further with the suit, which would cause serious prejudice to the petitioner and render the entire exercise futile, thereby constraining the https://www.mhc.tn.gov.in/judis
CRP No. 2743 of 2026 __________ Page3 of 4 petitioner to approach this Court seeking appropriate directions for expeditious disposal of the interlocutory application. 4.
Considering the facts and circumstances of the case, the learned Trial Judge is directed to dispose of I.A. No. 11 of 2026 in IA.No.3 of 2025 in O.S. No. 66 of 2025 on merits and in accordance with law, after affording sufficient opportunity to all parties, within a period of eight (8) weeks from the date of receipt of a copy of this order. The said application has been filed by the revision petitioner to establish that the alleged sale agreement relied upon by the plaintiff is a forged document. Till such time, the Advocate Commissioner shall not execute the warrant. 5. The learned counsel for the petitioner further submitted that, pursuant to the directions issued in Cont.P. No. 279 of 2026, an Advocate Commissioner has already been appointed. Taking note of the same, this Court is inclined to issue the above direction. 6. If any further relief is required, it is open to the revision petitioner to approach the appropriate forum, particularly in view of the intervening vacation. https://www.mhc.tn.gov.in/judis
