Angami, Government Advocate BEFORE HON'BLE MR. JUSTICE DEVASHIS BARUAH ORDER Date : 17.09.2026 Heard Mr. Supongwati Walling, the learned counsel appearing on behalf of the Petitioners and Mr. N. Angami, the learned Government Advocate appearing on behalf of the Respondents. 2. The Petitioners herein have approached this Court being aggrieved by the inaction on the part of the Respondents in not taking steps for regularization of the Petitioners in terms of the Office Memorandum dated 17.03.2015 in spite of the fact that the Petitioners fulfill the eligibility criteria. 3. Pursuant to the notice being issued in the instant proceedings, an affidavit-in-opposition has been filed Page No.# 3/4 by the Respondent Nos. 1 to 5. In the said affidavit- in-opposition, various documents have been enclosed. Annexure-A is the document issued by the Under Secretary to the Government of Nagaland, Finance Department (Establishment and ROP Cell) wherein the Finance Department have examined the cases of the various persons including the Petitioner Nos. 1 and 2 and have agreed to creation of 24 supernumerary posts to regularize the Petitioner Nos. 1 and 2 along with 22 others. 4. Insofar as the Petitioner No.3 is concerned, it is mentioned in the communication dated 14.08.2024 issued by the Executive Engineer, PHED to the Additional Chief Engineer & HoD (PHED) that the process of regularizing the Petitioner No.3 is at present taken up and the Petitioner No.3 is at Serial No.186 on the DLVC verified list. 5. Considering the above that the Respondents are taking due steps in terms of the Office Memorandum dated 17.03.2015, it is the opinion of this Court that it cannot be said that the Respondents have not taken any action in pursuance to the Office Memorandum dated 17.03.2015. 6. Accordingly, this Court therefore disposes of the Page No.# 4/4 instant writ petition with a direction upon the Respondent Authorities to take steps in accordance with the Office Memorandum dated 17.03.2015.
