Petitioners have filed this writ petition, seeking following reliefs:- “10.1 Issue an appropriate writ, order or direction and direct the respondent Authorities to kindly decide the claim of the petitioner in the light of the circular dated 10.05.1984 issued by the GAD for providing revised pay scale to the petitioners, in furtherance of justice. 10.2 Issue a writ of mandamus or any other appropriate writ order or direction, directing the respondent no. 3 to consider and pass an appropriate order in respect to the proposal forwarded by the respondent no. 1, in the interest of justice. 3 / 4 10.3 Grant any other relief(s) as this Hon’ble Court may deem just and proper in the facts and circumstances of the present case; ” 2. Learned counsel for petitioners submits that petitioners were initially appointed on the post of driver (daily wage employee) on Collectorate Rate. He submits that General Administrative Department of the erstwhile State of Madhya Pradesh has issued a circular for revised pay scale to be paid to employees in the Establishment Work Charged and Contingency Paid Employees, however, said benefit was not extended to petitioners. He further submits that earlier petitioners have submitted representation which was considered and recommendation was made for petitioners to be treated as employees of Work Charge and Contingency Establishment immediately after completion of three years from the date of initial appointment. Recommendation is made by the State Government, however, till date it is not acted upon, therefore, direction be issued to respondent no. 1 and 2 to pass further orders pursuant to the recommendation made vide Annexure P-10. 3. Learned counsel for State submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection. 4. On due consideration of submission made by learned counsel for respective parties, further considering the letter written on 26.06.2024 Annexure P-10, which is a recommendation made by State Government recommending that petitioners be declared to be an employees of the Work Charge and Contingency Establishment and entitlement for revised pay scale, this writ petition at this stage, is disposed of directing respondent no. 1 and 2 to consider and take 4 / 4 decision on letter Annexure P-10 dated 26.06.2024, in accordance with law, expeditiously, preferably within a further period of 08 weeks from the date of receipt of the Order and to pass further orders in this regard. 5.
