By the present Appeal, the Appellant, i.e. Original Opponent No.3 in Motor Accident Claim Petition No.162 of 1992, has assailed the judgment and award dated 3rd July 2001. 3. Mr. Parth Pitambare, learned Advocate for Respondent Nos.3, 4 and 5 (Original Claimants), states that the subject matter of this Appeal is settled. He tenders a photostat copy of the order dated 5th August 2008 passed by the learned District Judge-2 and Member, M.A.C.T., Sangli, in M.A.C.P. Darkhast No.19 of 2002. The same is taken on record and marked as “X” for identification, which reads thus: “ Order below Exh. 1 in MACP Darkhast No.19 of 2002 (Usha Prakash Mahadik Vs. Mahadeo Balku Bhosale).
