Soni, Advocate For the State :- Mr. Achinto Sen, Advocate ---- 03/13.02.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Bishnugarh P.S. Case No.34 of 2025 for the alleged offences registered under Sections 115(2), 126(2), 109, 352, 351(2), 351(3) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Hazaribag. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and the informant used to tease the sister of the petitioners and pursuant to that the altercation took place. He further submits that the injury is simple in nature and in view of that anticipatory bail may kindly be granted to the petitioners. 2026:JHHC:4216 --2-- A.B.A. No. 76 of 2026 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of forcefully taking away the informant and beating and in the FIR the allegations are there that the petitioners have come to the spot and started beating the victim and thereafter nearby people assembled. 5. The son of the informant was called to the police station on 01.03.2025 and while he was returning from the police station the petitioners have caught hold him and took to Tanda forest area and assaulted them brutally by knife, lathi, danda, iron rod and information came to the knowledge of the informant then he rushed to that place and anyhow managed to save his sons and thereafter the case has been lodged. 6. In the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners, hence, the prayer for anticipatory bail of the petitioners is hereby rejected.
