The instant writ petition has been filed inter alia praying for a direction upon the municipality to remove the illegal stalls/booths/goomties situate on the municipal footpath in front of the premises of the petitioner being holding No. 987, Bhudeb Mukherjee Road, Chandernagore, Hooghly. 3. The municipality is represented and would submit that since the writ petition is pending, no steps have been taken, however, the municipal authorities are in the process of taking steps for removal of illegal stalls/booths/goomties situate on the municipal footpath in front of the premises of the petitioner being holding No. 987, Bhudeb Mukherjee Road, Chandernagore, Hooghly. 4. Having heard the learned advocates appearing for the respective parties and having regard to the submissions made in Court today by the municipal 2 WPA 20 of 2025 authority I am of the view that no useful purpose will be served in keeping the writ petition pending. Accordingly, the writ petition is disposed of by taking note of the show cause notice dated 15th July, 2025, which has been disclosed by the petitioner, issued on the occupants of the stalls/booths/goomties by the municipal authority, with a direction upon the municipality to take immediate steps in furtherance to such show cause notice in accordance with law and if, the stall/booths/goomties are found to have been set up illegally, remove the same in accordance with law. The entire exercise must be completed within a period of eight weeks from the date of communication of this order.
