3. This is second bail application. First bail application was dismissed as withdrawn by the Coordinate Bench of this Court vide order dated 06.01.2026 with liberty to file fresh.
4. Present second bail application is moved by the applicant, who is in judicial custody in connection with FIR/Case Crime No.146 of 2025 under Section 109(1), 118(1), 118(2), 351(2) of Bhartiya Nyaya Sanhita, 2023, Police Station-Jhabreda, District Haridwar.

Learned counsel for the applicant submits that applicant and the injured are the real brothers and in his testimony before the Court, the injured has not supported the prosecution story thereby no case is made out against the applicant and he has an advantage of being enlarge of bail.
6. Learned State counsel opposed the bail application.
7. Considering the facts and circumstances of the case and also considering the statement of the injured/complainant grounds are sufficient to enlarge the applicant on bail.
8. Accordingly, bail application is allowed. Let the applicants-Pramod and Azad be released on bail on their executing a personal bond and
two reliable sureties of the like amount to the satisfaction of court concerned.
