ORDER 06-06-2026 01. The appellants have challenged interim ex parte order dated 16th of May 2026 passed by the learned Principal District Judge, Kupwara, whereby a direction has been issued that no cricket match or activity shall be held at Galizoo Kupwara, under the name of Kupwara Forest League. The said order has been passed by the learned District Judge in exercise of powers under Order 39 Rules 1 and 2 of CPC. While passing the aforesaid order, the matter has been posted on 10th of June 2026. 02. The appellants have without appearing before the learned trial court and without seeking variation/modification of the aforesaid order, rushed to this Court by way of the instant appeal. 03. After arguing for a while, learned counsel for the appellants seeks permission of this Court to withdraw the instant appeal and to approach the learned trial court for seeking modification/discharge of the ex parte interim order dated 16th of May 2026. Learned counsel for the appellants has submitted that the appellants have already filed their written statement before the learned trial court. If that be so, the learned trial court shall take expeditious steps for disposal of the interim application of the plaintiff, keeping in view the mandate of Order 39 Rule 3A CPC.
