Issue a writ, order or direction in the nature of certiorari to quash impugned order dated 17.04.2026 passed by the Additional District Judge/F.T.C-I, District Hathras in L.A No. 1/2016 (State Vs Dinesh) pending before him. II Issue a writ, order or direction in the nature of mandamus stay the proceeding of L.A No. 1/2016 (State Vs. Dinesh & others) pending before Additional District Judge/F.T.C-I, District- Hathras till disposal of First Appeal No. 1163/2025 pending before this Hon'ble Court. III. Issue any other writ, order or direction in the nature as this Hon'ble court may deem fit and proper in the circumstances of the case. IV. Allow the Writ petition with costs in favour of the petitioner." 3. The order dated 17.04.2026 which is subject matter of challenge which reads as under.- "प्ऴावली पेश हुई, प्षकार उपिस्थत। िवरोधी िदनेश चं्श ्षारा माननीय उच्च न्यायालय, इलाहबाद से स्थगन ्ऺाप्त करने हेतु समय चाहा गया। मामला ्ऺाचीन है तथा वषर् 2016 से लंिबत है। िवरोधी िदनेश चं्श व राम स्वरुप आिद के मध्य लंिबत मूलवाद संख्या 63/2016 को गुणदोष पर न्यायालय िसिवल जज जूिनयर िडवीजन, सादाबाद, हाथरस ्षारा िनिणत करते हुए िदनांक 23.09.2025 को िनरस्त िकया जा चुका है। िवप्षी िदनेश चं्श ्षारा अभी तक कोई स्थगन ्ऺाप्त नहीं िकया जा सका है। अतः िवप्षी िदनेश चं्श को स्थगन ्ऺाप्त करने हेतु अंितम अवसर िदया जाता है, अन्यथा की िस्थित में प्ऴावली का िनस्तारण प्ऴावली पर उपलब्ध साष्य के आधार पर गुण-दोष पर िकया जाएगा। प्ऴावली कोटर् सुनवाई िदनांक 01.05.2026 को Versus Counsel for Petitioner(s) : Mohd. Ayub, Roopnandini Counsel for Respondent(s) : A.S.G.I., C.S.C., Pranjal Mehrotra, Rajesh Kumar Jaiswal Dinesh Chandra @ Dinesh Gupta .....Petitioner(s) Union Of India And 3 Others .....Respondent(s) पेश हो।" 4. Learned counsel for the respondent while inviting attention towards page 64 contend that already First Appeal No. 1163 of 2025 is pending in which the following orders have been passed.- "1. Sri Pranab Kumar Ganguli, is representing respondent nos. 4/1, 5/1, 5/2, 5/3, 5/4 and respondent no.6. 2. Mohd. Ayyub is representing respondent nos. 7/1, 7/2, 7/3, 7/4, 7/5, 8 and 9. 3. None is appearing on behalf of the respondent nos.1, 2 and 3. In such view of the matter, issue notice to respondents no. 1, 2 and 3. 4. Respondents shall file counter affidavit within the aforesaid period, if required. 5. Rejoinder affidavit, if any, may be filed within two weeks thereafter. 6. List this matter on 16.07.2026 as fresh." 5. By virtue of the order impugned, opportunity has been accorded to the present petitioner to obtain an interim order in the pending appeal wherein according to the petitioner, the dispute is regarding title. In the opinion of the Court, it is for the writ petitioner to praise for interim relief in the pending fresh relief. 6. With the said observation, the petition stands disposed of.
