1. This hearing has been done through hybrid mode. 2. By the way of the present petition the petitioner is seeking quashing of FIR No. 395/2023, registered at Police Station Bharat Nagar, District North West, Delhi, for offences punishable under Sections 498A/406/34 of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP for the State accepts notice on behalf of the State. This is a digitally signed order. 4. The Petitioners are present before this Court, while Respondent No.2 has joined the proceedings through video conferencing (“VC”). The parties have been duly identified by their respective learned counsel as well as by the Investigating Officer. 5. Briefly stated, the marriage between Petitioner No.1 and Respondent No.2 was solemnized in the year 2018. No child was born out of the wedlock. With the passage of time, matrimonial differences arose between the parties, whereafter they began residing separately. Respondent No.2 thereafter lodged a complaint alleging cruelty, harassment and non-return of stridhan articles against the Petitioners. The complaint culminated in the registration of the aforementioned FIR. Upon completion of the investigation, a charge-sheet came to be filed against the Petitioners. 6. During the pendency of the proceedings, the parties amicably resolved their disputes in terms of the Settlement dated 20.09.2023. In furtherance thereof, their marriage was dissolved by a decree of divorce by mutual consent dated 03.07.2024. Respondent No.2 also agreed to extend her cooperation for quashing the subject FIR. 7. It is in the aforesaid circumstances that the Petitioners have approached this Court seeking quashing of the subject FIR and all proceedings emanating therefrom. 8.
On a query put by this Court, Respondent No.2, who has also been identified by the Investigating Officer, categorically states that she entered into the Settlement Agreement dated 20.09.2023 of her own free will and without any pressure, coercion or threat. She further states that she has no objection if the subject FIR and the proceedings emanating therefrom are quashed. This is a digitally signed order. In view of the fact that the parties have amicably resolved all their disputes, the marriage between Petitioner No.1 and Respondent No.2 already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount stands paid, and Respondent No.2 has no objection to the quashing of the subject FIR, no useful purpose would be served by continuing the criminal proceedings. Rather, their continuation would only perpetuate unnecessary litigation between the parties. In the facts and circumstances of the present case, there is no legal impediment to quashing the subject FIR. 10. Accordingly, FIR No.395/2023, registered at Police Station Bharat Nagar, District North West, Delhi, for the offences punishable under Sections 498A/406/34 of the IPC, along with all consequential proceedings emanating therefrom, is hereby quashed. 11. The present petition is disposed of in the aforesaid terms. Pending application(s), if any, also stand disposed of. 12. A copy of this order be sent to the learned Trial Court for necessary information and compliance. 13. The order be uploaded on the website forthwith.
