P.P. …...... 05/16.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 80(2), 3(5) of the Bharatiya Nyaya Sanhita and Sections 3 & 4 of Dowry Prohibition Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. Petitioner is the husband. It is alleged that due to non fulfilment of demand of dowry, the petitioner and others have committed murder of the deceased, who is none, but the daughter of the informant. 5. After hearing the parties and after going through the record, I find that except the ligature mark there are no other injury. The Doctor opined that the death is due to hanging and admittedly at the time of death, the petitioner was in Bangalore. The petitioner after some quarrel had left for Bangalore and thereafter, the incident had occurred. 6. Considering the aforesaid fact, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Deoghar in connection with Sonaraithari Police Station Case No.35 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his own name within the State of Jharkhand.
