The petitioners are apprehending their arrest in connection with Complaint Case No.1766/2008, registered for the offence under Sections 304B, 201, 498A, 506 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that petitioner nos. 1 and 2 are brothers-in-law and petitioner no.3 is the mother-in-law of the deceased. He further submits that the case has been lodged against the petitioners and others by way of filing complaint petition alleging therein that the petitioners have killed the deceased by sprinkling kerosene oil and put her on fire. He then submits that the learned Court has called for a report from the police and the inquiry report has been made available by the police ( 2026:JHHC:4240 ) -2- A.B.A. No. 851 of 2026 and in that report, it has been disclosed that on inquiry the villagers have stated that the death was natural, contained in Annexure-2. He refers to report at Annexure-2, which was filed before the learned Court. 4. Learned counsel appearing for the State opposed the prayer and submits that the matter is arising out of complaint case. 5. Annexure-2 is the report of the police which suggests that the death has occurred naturally. Petitioner nos. 1 and 2 are brothers-in-law and petitioner no.3 is the mother-in-law of the deceased. 6. In that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions as the learned Court may deem fit and proper. 7.
