The petitionersare apprehending their arrest in connection with Seraikella P.S. Case No. 99/2025, registered for the offence under Sections 126(2)/115(2)/74/109/352/351(2)/3(5) of the BNS, 2023, pending in the Court of the learned Chief Judicial Magistrate, Seraikella. 3. Learned counsel appearing for the petitioners submit that there are case and counter case between the parties and the first case was lodged by the petitioners’ side and thereafter, the present case has been lodged. He also submits that the petitioners are having no criminal antecedent, as disclosed in paragraph no.1 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault are there and injury is said to be grievous. 5. Looking to the contents of the F.I.R., it transpires that there is direct allegation of assault and molestation against petitioner No. 1, namely, 2026:JHHC:3833 2 Tarun Kumar @ Tarun Kumar Gupta and in that view of the matter, I am not inclined to extend the privilege of anticipatory bail to the petitioner No. 1 and as such, the prayer for anticipatory bail of the petitioner No. 1 is, hereby, rejected. 6. So far as the petitioner nos. 2 and 3 are concerned, there are general and omnibus allegation against them and there are case and counter case between the parties. It has been pointed out that they have no criminal antecedent, as disclosed in paragraph no.1 of the petition, I am inclined to extend the privilege of anticipatory bail to the petitioner Nos. 2 and 3, namely, Aryan Kumar and Rita Devi. 6. Accordingly, the above-named petitioner nos. 2 and 3 are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Seraikella P.S. Case No. 99/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
