1. Petitioner herein seeks quashing of FIR No. 0194/2026 dated 31.05.2026, registered at Police Station Malviya Nagar, for commission of offences under Sections 281/125(a) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 279/337 IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. and daughter, was returning from Guruji Ashram situated in Chhatar Pur. At Aurbindo Marg, Adhchini traffic signal, one Audi car came from Katwaria Sarai side. Such Audi car was being driven at a fast speed and in rash and negligent manner and collided with Swift Dzire driven by the complainant. On account of such accident, complainant and his family members sustained injuries and their car also got damaged. 3. Offending car was being driven by petitioner herein and on the basis of report lodged by complainant Mr. Rashim Gulati, the aforesaid FIR was registered. 4. Charge-sheet has already been filed. 5. The quashing is being sought for the reason that the parties have amicably settled the matter. 6. Settlement Deed dated 15.07.2026 has been placed on record. 7. Respondent No. 2 has joined the proceedings through video-conferencing. He is accompanied by his wife. 8. When asked, he submitted that matter has been amicably settled and he is left with no grievance in the present matter and would have ‘no objection’ if FIR in question is quashed.
It was specifically asked whether he wanted any compensation and reimbursement of medical expenditure with respect to the injuries and damage to the car, but he claimed that they have entered into settlement without any monetary consideration and would have no objection to the quashing of FIR. He also submits that when the matter was taken up by learned Presiding Officer, Motor Accident Claim Tribunal, it was informed to the learned Tribunal also that the parties had settled the matter and that they were not interested in pursuing the aforesaid claim and in view of such statement, even Detailed Accident Report (DAR) was disposed of, as Signed By:SONIA THAPLIYAL Signing Date:14.08.2026 17:25:30

withdrawn/settled. 9. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), it is deemed appropriate to quash the instant FIR. 10. Consequently, to secure the ends of justice FIR No. 0194/2026 dated 31.05.2026, registered at Police Station Malviya Nagar, for commission of offences under Sections 281/125(a) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 279/337 IPC), along with all consequential proceedings arising therefrom, is quashed. 11. Original Settlement Deed and original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks, so that these become part of Trial Court Record. 12. The petition stands disposed of in aforesaid terms. 13. Other pending application also stands disposed of in aforesaid terms.
