The order impugned is an order passed by the court of learned Chief Judicial Magistrate, Pulwama under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (for short, ‘the Act of 2005’). The order impugned is clearly appealable under Section 29 of the Act of 2005.
In the face of availability of statutory remedy of appeal provided under the Act of 2005, the invocation of jurisdiction of this Court under Article 227 of the Constitution of India is highly uncalled for. Therefore, the petition is not maintainable, the same is, accordingly, dismissed with liberty to the petitioner to avail the remedy of appeal available under the Act of 2005.
