The present writ petition has been filed seeking demolition of unauthorised construction being carried out over the terrace of third floor of property bearing No. B-1/B, Hari Nagar, Ashram, New Delhi-110014 (‘subject property’). 2. It is stated that the petitioner resides on the ground floor of the subject property whereas respondent no.3 resides on the third floor of the subject property and is carrying out construction on the terrace of the third floor. 3. Counsel appears on behalf of the respondent/MCD on advance notice submits that the unauthorised construction of the structure at third floor and This is a digitally signed order. In view thereof, the present writ petition is disposed of while directing respondent respondent/MCD to take action in accordance with law in an expeditious manner. 6. Liberty is given to the petitioner to approach the Court in the event the petitioner has any further grievance. 7. All rights, contentions and legal remedies of the private respondents are kept open.
