Learned counsel for the petitioner, while reiterating the contents of the affidavit, submitted that a representation was made seeking appointment of the petitioner as a Fair Price Shop Dealer on compassionate grounds. However, the said representation has not been considered so far. She further submitted that it would suffice for the time being if a direction is given to the concerned Revenue Divisional Officer (RDO) to consider the petitioner’s representation and pass appropriate orders in accordance with law. As such, prayed to pass appropriate orders protecting the interest of the petitioner. 4. On the other hand, the learned Assistant Government Pleader, on instructions, submitted that the petitioner has not approached the concerned authority and no representation was made in that regard. He further submitted that the representation placed on record does not bear any endorsement evidencing its submission before the concerned authority. In such 4 circumstances, the question of considering the said representation does not arise. Even otherwise, the petitioner is not entitled to compassionate appointment as a Fair Price Shop Dealer. As such, the writ petition is devoid of merits and is liable to be dismissed. 5. In reply, learned counsel for the petitioner submitted that liberty may be granted to the petitioner to submit a fresh and detailed representation to the authority concerned. 6. In the absence of such proof, this Court cannot presume that the representation was duly submitted. As such, a direction cannot be given to the authorities to consider the same. 8. In view of the above, and as the petitioner has an intention to submit a fresh representation/application, instead of going into 5 the merits and demerits of the case and decide whether the petitioner is entitled for appointment on compassionate grounds or not, this Court is inclined to dispose of the writ petition by passing the following directions: (i) The petitioner is at liberty to submit a detailed representation to the concerned authority within a period of two (02) weeks from the date of receipt of a copy of this order. (ii) Upon receipt of such representation, the competent authority shall consider the same and pass a reasoned order, in accordance with law, within a period of four (04) weeks thereafter, and communicate the same to the petitioner. 9. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous applications pending, if any, shall stand closed. ___________________________ JUSTICE RAVI CHEEMALAPATI Date: 20.01.2026 ANS 6 222 THE HONOURABLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO: 1102/2025 Date: 20.01.2026 ANS
