Borang, learned counsel, appearing for the petitioners, on instructions, prays for withdrawal of the petition. She seeks liberty to file a fresh petition, as some inadvertent errors occurred while filing the instant petition. Mr. T. Ete, learned Addl. P.P. does not have any objection to the prayer of the petitioner. Liberty is granted. In view of the above, the instant criminal petition is dismissed on withdrawal with liberty to file a fresh petition. It is pointed out that there is an interim order operating in the instant case, whereby the proceeding of GR Case No. 187/2011, pending before the Chief Judicial Magistrate, Yupia, has been suspended. In view of the withdrawal of the instant case, the interim order of suspension passed, vide order dated 06.06.2023 is hereby cancelled. The Registry is directed to send back the TCR in connection with the instant case immediately to the court of learned Chief Judicial Magistrate, Yupia. JUDGE Miriam Degu (SPA)
