When the case is called, both parties are present before this Court. Mr. Samarjit Bhattacharjee, learned counsel appearing for the respondent Nos. 1 and 2 submits before this Court that the subject-matter involved in this present appeal has already been decided by this Court in Mac. App No. 76 of 2025 dated 01.12.2025 and in view of the same, no further orders are required in this present appeal. Mr. R.G Chakraborty, learned counsel appearing for the applicant, in all fairness conceded the submission of the learned counsel of the respondents and seek permission to withdraw the same. Upon hearing the submission of both the parties, this present application stands dismissed as withdrawn. Resultantly, the connected appeal also stands dismissed as withdrawn.
