Petitioner apprehends arrest in a case registered for the offences punishable under Sections 366(A) of Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act. 4. It is alleged this petitioner along with two unknown persons kidnapped the niece of informant. 5. Learned counsel appearing for the petitioner submits that during investigation, victim was recovered and in her statement, recorded under Section 183 BNSS, she denied the Patna High Court CR. MISC. No.5123 of 2026(5) dt.07-05-2026 2/2 prosecution case and has categorically stated that she herself fled away from the house and went to the house of her friend in Begusarai for further studies, as her parents were forcing her to get married. Learned Trial Court assessed age of the victim to be 18 years. Petitioner claims clean antecedent. 6. Learned A.P.P. for the State vehemently opposed the bail application. 7. Considering statement of the victim recorded under Section 183 BNSS, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act, Khagaria in connection with Alauli P. S. Case No. 71 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. Navya/- (Prabhat Kumar Singh, J) U T
