The H.P. State Electricity Board Ltd. vs. Himachali Devi CMP (M) No. 777/2026 8.7.2026 Present: Ms. Sunita Sharma, Sr. Advocate with Ms. Harshita Dogra, Advocate, for the applicants. None for the respondents. CMP (M) No. 777/2026 As per report of the Registry, notices issued for the service of the respondents have been received back duly served, however none has put in appearance on their behalf. Therefore, the respondents are proceeded against ex parte. The present application has been filed for condonation of delay in filing the main appeal. It has been averred in the application that certified copy of the impugned judgment and decree, dated 03.09.2024 was applied on 04.09.2024 and delivered on 19.09.2024. Thereafter, the certified copy of the judgment was sent to superior authority for seeking legal opinion and the matter was examined at various levels for filing the appeal and in this process, considerable delay has occurred, which is neither intentional nor deliberate, but the same is due to unavoidable circumstances, which were beyond the control of the applicants. Consequently, in view of the reasons stated in the application, more particularly in paras 3 to 6 thereof, which is duly supported by an affidavit, coupled with submissions made by the learned counsel for the applicants, delay in filing the main appeal is condoned. Appeal be registered. Application stands disposed of. RSA No. /2026 Send for the records. List for admission after two weeks. (Romesh Verma) Judge 8.7.2026 (pankaj)
