JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the registration of a crime in Crime No.0088/2024 for the offences punishable under Sections 323, 498A, 504, 506 and 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Smt. Vijetha R. Naik, learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri. R. Kiran, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:21779 CRL.P No. 2969 of 2025 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application under Section 320 read with Section 482 of the Cr.P.C., along with Verifying Affidavit of respondent No.2. The application so filed reads as follows: “APPLICATION UNDER SECTION 320 R/W SECTION 482 OF CODE OF CRIMINAL PROCEDURE The Petitioner and Respondent No.2 respectfully submit as follows: 1. The Petitioner has filed the above Criminal Petition seeking quashing of FIR in Crime No.0088/2024 registered by Chitradurga Women Police Station, Chitradurga, for the offences punishable under Sections 323, 498A, 504, 506 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. It is submitted that the said FIR in Crime No.0088/2024 was registered at the instance of Respondent No.2 arising out of matrimonial disputes between the Petitioner and Respondent No.2. The matter is presently pending before the learned I Addl. Senior Civil Judge and JMFC, Chitradurga for adjudication. 3. The marriage between the Petitioner and Respondent No.2 was solemnized on 15.12.2023 at Kamma Reddy Samudaya Bhavana, Chitradurga as per Hindu rites and customs. There are no children born out of the wedlock. However, shortly after the marriage due to misunderstandings, incompatibility and differences of opinion, disputes arose between the parties, resulting in initiation of multiple proceedings, namely: a) Crime No.0088/2024 registered on the complaint lodged by the 2nd Respondent by Chitradurga Women Police Station for offences under Sections 323, 498A, - 4 - HC-KAR NC: 2026:KHC:21779 CRL.P No. 2969 of 2025 504, 506 r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act; b) Crl. Misc. No.1465/2024 filed by Respondent No.2 under Sections 18, 19 and 20 of the Protection of Women from Domestic Violence Act, pending before the Principal Civil Judge & JMFC, Chitradurga; c) MC No.9/2025 filed by the Respondent No.2 under Section 9 of the Hindu Marriage Act for restitution of conjugal rights before the I Addl. Senior Civil Judge, Chitradurga; d) M.C. No.153/2025 filed by both parties under Section 13(B) of the Hindu Marriage Act for divorce by mutual consent before the II Addl. Senior Civil Judge & JMFC, Chitradurga. 4. During pendency of the above proceedings, elders and well-wishers of both families intervened and the parties have amicably settled their disputes. 5. It is submitted that pursuant to the settlement, the parties filed a joint petition under Section 13(B) of the Hindu Marriage Act In M.C. No. 153/2025. The said petition has been allowed and the marriage between the parties has been dissolved by a decree of divorce by mutual consent dated 04.12.2025 passed by the II Addl. Senior Civil Judge & JMFC, Chitradurga. 6. The Petitioner and Respondent No.2 since decided to resolve the dispute amicably, as part of the full and final settlement have mutually agreed to the following terms and conditions: i) The Petitioner has agreed to pay a total sum of Rs.30,00,000/- (Rupees Thirty Lakhs only) to the Respondent No.2 towards permanent alimony, maintenance (past, present and future), stridhan, marriage expenses and all other claims. ii) Out of the said amount, Rs.25,00,000/- has been paid through Demand Draft bearing Nos.900721 and 900720, both dated 20.11.2025 and Rs.5,00,000/- has been paid in cash. - 5 - HC-KAR NC: 2026:KHC:21779 CRL.P No. 2969 of 2025 iii) The Respondent No.2 acknowledges receipt of the entire sum of Rs.30,00,000/- and declares that no further amount/claim is due from the Petitioner. iv) The Respondent No.2 undertakes not to pursue Crime No.0088/2024 and consents for quashing of the said FIR and all consequential proceedings. v) Both parties agree to withdraw/close all pending proceedings mentioned above. vi) Both parties agree that they shall not initiate any civil or criminal proceedings against each other in future in respect of the matrimonial dispute. vii) The compromise is entered voluntarily without coercion, undue influence or pressure. 7. It is submitted that the offences alleged in Crime No.0088/2024 are purely matrimonial in nature and arise out of personal discord between the parties. In view of the settlement and dissolution of marriage, continuation of criminal proceedings would serve no useful purpose and would amount to abuse of process of Court. 8. It is submitted that the Respondent No.2, being the complainant in the FIR, has voluntarily joined this compromise application and expressly states that she has no objection to quashing the FIR and all further proceedings arising therefrom. 9. Further the Petitioner and the Respondent No.2 hereby withdraw all allegations made against each other unconditionally and also undertake not to interfere in each other's life henceforth. WHEREFORE, the Petitioner and Respondent No.2 jointly pray that this Hon'ble Court may be pleased to allow this petition by recording the compromise entered into between the parties and quash FIR in Crime No.0088/2024 registered by Chitradurga Women Police Station for offences under Sections 323, 498A, 504, 506 r/w 34 IPC and Sections 3 & 4 of the Dowry Prohibition Act and all consequential proceedings pending before the jurisdictional Court, in the interest of justice and equity.” - 6 - HC-KAR NC: 2026:KHC:21779 CRL.P No. 2969 of 2025 4. The petitioner through his GPA holder and respondent No.2 are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Crime No.0088/2024 pending before the I Additional Senior Civil Judge and JMFC, Chitradurga, stands quashed qua the petitioner.
