The present petition has been filed seeking to assail the order dated 13.08.2026 passed by the Additional District Judge, 6th, Gautam Budh Nagar in SCC Suit No. 3 of 2025, whereby the application filed by the respondent-landlord under Order 15 Rule 5(1) read with Section 151 CPC has been allowed. Learned counsel appearing for the petitioner states that the order impugned would be subject to a further statutory legal remedy and in view thereof he seeks withdrawal of the petition with liberty to take recourse to the appropriate statutory legal remedy.
