HON'BLE MR. JUSTICE GANESH RAM MEENA Order 29/01/2026 1. The accused-petitioners have filed this bail application under Section 483 B.N.S.S., arising out of F.I.R. No.208/2025 registered with the Police Station Kanwas, District Kota Rural for offence under Sections 126(2), 115(2), 110 and 3(5) of B.N.S., 2023. 2. The learned counsel for the accused-petitioners submits that the allegations against the accused-petitioners in the F.I.R. are of giving beatings to the complainant by a wooden stick on his back. He further submits that the accused-petitioners have been falsely implicated in this case and the grievous injury sustained by the injured, Dhanraj, is not attributed to the present accused- petitioners. He also submits that the accused-petitioners are in custody since 16.12.2025 and trial of the case is likely to take [2026:RJ-JP:4132] (2 of 2) [CRLMB-53/2026] considerable time to conclude, therefore, the accused-petitioners may be enlarged on bail. 3. Learned Public Prosecutor has vehemently opposed the bail application and submits that there is active involvement of the accused-petitioners in the alleged incident. 4. Considered the submissions made by counsel for the petitioners as well as learned Public Prosecutor and also perused the case diary. 5. Taking into consideration the overall facts and circumstances of the case and more particularly the fact that the grievous injury sustained by the injured is not attributed to the present accused-petitioners, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the accused-petitioners on bail. 6. This bail application is, accordingly, allowed and it is directed that accused-petitioners shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that they shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.
