03/13.02.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Bengabad P.S. Case No.56 of 2025, registered for the offence under Sections 126(2), 115(2), 118(1), 118(2), 109(1), 324(2), 304(2), 3(5) of the BNS, pending in the Court of the learned C.J.M., Giridih.

Learned counsel appearing for the petitioners submits that there are case and counter case between the parties. He further submits that for the same incident, the petitioners have also lodged the case. He then submits that the allegation has been made in the FIR of assault upon the informant side including the pregnant lady, however, that fact is not correct. He next submits that in the medical report, injury is said to be simple.

Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault are there.
5. Considering that there are case and counter case between the parties

and it has been pointed out that for the land, the proceeding under Section 144 Cr.P.C. was also initiated and in the FIR, serious allegations are made, however, the injury is said to be simple and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions as the learned Court may deem fit and proper.
6. Accordingly, this application is disposed of.
