JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accepts notice for respondent No.1. 2. Ms. M.R.Sinchana, learned counsel is directed to accept notice for respondent Nos.2 to 7. 3. Petitioner is before this Court seeking for the following reliefs: a. Issue writ or order in the nature of Mandamus or such order this Hon'ble Court may deem fit to Consider the Representation dated 15/09/2025 made by the Petitioner to the Respondent no 2 produced at Annexure-A. b. Issue writ or order in the nature of Mandamus or such order this Hon'ble Court may deem fit to Consider the Representation dated 29/08/2025 made by the Petitioner to the Respondent no 3produced at Annexure- A1. c. Issue writ or order in the nature of Mandamus or such order this Hon'ble Court may deem fit to Consider the Representation dated 29/08/2025 made by the Petitioner to the Respondent no 4 produced at Annexure-A2. d. Direct the Respondents to release the outstanding payment of 21,36,41,390/- (Rupees One Crore Thirty- Six Lakh Forty-One Thousand Three Hundred and Ninety only) along with interest at the rate of 6% per annum from the date of the bills until the date of actual - 4 - HC-KAR NC: 2026:KHC:10948 WP No. 1960 of 2026 payment, following the precedent set in W.P 16851/2024. at Annexure-K e. Grant such other reliefs as this Hon'ble Court deems fit in the interest of justice and equity. 4. The grievance of the petitioner is that the bills which had been raised by the petitioner in pursuance of the work carried out pursuant to a work order issued have not been paid. 5. Whenever bills are raised by any contractor, it is required for the employer like respondent No.2 to consider the same and pass necessary orders either by accepting the bills submitted or rejecting the bills submitted. 6. Needless to say, in both cases it would have to be accompanied by reasons. In the present case, the bills having been raised and not having been paid, has forced the petitioner to approach this Court. In that background, I passed the following: ORDER i) Writ petition is allowed. ii) A mandamus is issued, directing respondent No.2 to consider the bills submitted by the petitioner in - 5 - HC-KAR NC: 2026:KHC:10948 WP No. 1960 of 2026 terms of the representation of Annexure A, A1 and A2 within a period of 60 days from the date of receipt of a copy of this order in terms of the work order and/or contract entered into between the parties. iii) It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner.
