Ms. Monika Jhajharia, Adv. with Mr. Rajendra Singh, Adv. and Mr. Sunil Vijay, Adv. For Respondent(s) : Mr. Rhishiraj Singh Rathore, PP with Mr. Anirudh Singh, Astt. Adv. HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 19/01/2026 1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR [2026:RJ-JP:2241] (2 of 3) [CRLMB-40/2026] No.937/2025, registered at Police Station Sanganer Sadar, District Jaipur City (South), for the offence(s) under Sections 331(4) and 305(a) of BNS. 2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in the present case. It is contended that the other co-accused from whom the recovery was effected, have already been enlarged on bail by the trail Court and the case of the present petitioners are akin to the other co- accused. The petitioners have been made accused on the basis of joint recovery made from the petitioners and the other co- accused. The accused-petitioners are in custody since more than one month, the matter is exclusively triable by Magistrate and the trial of the case may take considerable time, therefore, the bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case. The accused-petitioners are in custody since long, the matter is exclusively triable by Magistrate, there are no criminal antecedents against the accused-petitioners and the trial of the case may take considerable time, therefore considering the above facts, this Court deems it just and proper to enlarge the accused- petitioners on bail. 6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely; 1. Mahesh Sharma S/o Ramulal Sharma and 2. Pushpendra @ Golu S/o Ramkishor Mahawar, in connection [2026:RJ-JP:2241] (3 of 3) [CRLMB-40/2026] with FIR No.937/2025, registered at Police Station Sanganer Sadar, District Jaipur City (South), shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
