01. 1. Both the ABLAPLs are taken up for orders. 2. Heard learned counsels for the respective parties. 3. Instant petitions under Section 482 BNSS are filed seeking pre-arrest bail of the petitioners in connection with Special G.R No. 25 of 2026 pending in the file of learned Special Judge -cum- Sessions Judge, Nayagarh arising out of Nayagarh P.S Case No. 92 of 2026 on the grounds stated. 4. On perusal of the F.I.R. at Annexure-1, the Court finds that from one of the accused persons, namely, Hapus @ Hakim Khan, a pouch was recovered containing therein 9.40 grams of Brown sugar. It is submitted by learned counsel for the petitioners that such recovery has been made from the above named accused and since both are having no other similar antecedent, they should be allowed to go on bail with any conditions. Recorded the submission of Mrs. Mohanty, learned ASC for the State. It is made to understand from the F.I.R. that the accused, namely, Ranu Barad @ Sarojini managed to flee from the spot on seeing the police party whereas the other accused alleged to have supplied the contraband substance. Such a disclosure has been made from the male accused nabbed at the spot. Admittedly, the recovery relates to less than commercial quantity of contraband Brown sugar. Considering the F.I.R., submissions of learned counsel for the respective parties and since the recovery and seizure has been made from the co-accused caught at the spot and not from the petitioners, who claim to have no past antecedents, this Court, recording the objection of the State, is inclined to direct them to surrender before the learned court below for being released pending investigation though it is not inclined to entertain their plea for pre-arrest bail. 5. Accordingly, it is ordered. 6. In the result, the ABLAPLs are disposed of with the direction as aforesaid.
In the event, the petitioners surrender
before the court of learned Special Judge -cum- Sessions Judge, Nayagarh within a fortnight from today, it is directed that they shall be released on bail in connection with Nayagarh P.S Case No. 92 of 2026 corresponding to corresponding to Special G.R No. 25 of 2026 on furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. The above order, as is further directed, shall be subject to absence of any similar antecedents against the petitioners. 7. Issue urgent certified copy of this order as per rules. (R.K.
