G VENKATA REDDY Counsel for the Respondent(S): 1. GP FOR ENDOWMENTS The Court made the following Order: Heard Sri G. Venkata Reddy, learned counsel for the petitioners, the learned Assistant Government Pleader for Endowments and Sri Kappera Kotewsara Rao, learned Standing Counsel for the respondent No.4. 2. The challenge in the subject writ petition is to the proceedings of the respondent No.4, dated 23.12.2025 requiring the petitioner to vacate from 4 the subject premises of an extent of Ac.8.76 cents, Sy.No.122, Ponnapalli Village, Cherukupalli Mandal, Bapatla District. 3. The contention of the petitioners is that the respondents have not granted any opportunity to submit their explanation to the impugned proceedings as provided under Section 83(2) of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987. 4. Learned counsel for the petitioners submits that in 2016, the similar notice was issued to the petitioners and the same was challenged by way of a Writ Petition No.18565 of 2016. The said writ petition was disposed of on 08.11.2024 granting liberty to the respondents to take steps in accordance with law until then the respondents were directed not to take any coercive steps against the petitioners. Pursuant to the said order, the impugned proceedings have been issued without providing any opportunity to the petitioners to put forth their case. A perusal of the impugned proceedings would reflect that the eviction proceedings were passed without providing any opportunity to the petitioner. 5. Having regard to the contentions advanced, this Court deems it appropriate to dispose of the Writ Petition by setting aside the impugned proceedings, dated 23.12.2025 and the respondent No.4 is granted liberty to issue notice under Section 83(2) of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 before passing the order of eviction against the petitioners. Upon issuance of the said notice, the 5 respondents shall pass appropriate orders within a period of eight (08) weeks from the date of receipt of this order in accordance with law. 6. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall also stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA Dated: 08.01.2026 MSI 6 THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 937/2026 Dated: 08.01.2026 MSI
