1. The Petition, being CM(M) 1478/2026, has been filed under Section 227 of the Constitution of India, 1950 [“Constitution of India”], seeking the following reliefs: This is a digitally signed order. “A. Issue an appropriate Order or direction under Article 227 of the Constitution of India and quash and set aside the impugned Orders dated 05.05.2026 and 07.07.2026 passed by the Learned Judge, Family Court-02, Shahdara District, Karkardooma Courts, Delhi in Hindu Adoption Petition No.08/2019 titled "Lavanya Sagar & Anr. v. Anil Sagar", being illegal, arbitrary, contrary to settled principles governing judicial discretion and violative of the Petitioners' right to a fair opportunity of hearing. B. Set aside the directions whereby the Petitioners' right to further cross-examine Respondent Witness No.l was closed and restore the said right by directing the Learned Trial Court to afford the Petitioners one effective and meaningful opportunity to complete the cross-examination of Respondent, subject to such terms and conditions as this Hon'ble Court may deem fit and proper. C. Set aside all consequential proceedings undertaken pursuant to the impugned Orders dated 05.05.2026 and 07.07.2026, including the closure of the Respondent's evidence and the fixation of the matter for final arguments, and restore the proceedings to the stage immediately preceding the passing of the impugned orders. D. Pass such further or other order(s) OR direction(s) as this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the present case to secure the ends of justice.”
2. The Petition, being CM(M) 1485/2026, has been filed under Section 227 of the Constitution of India, seeking the following reliefs:
“a) Issue an appropriate order or direction, more particularly quashing and setting aside the impugned order dated 16.04.2026 passed by the Ld. Principal Judge, Family Court, Karkardooma Courts, Delhi, whereby the transfer petition preferred by the petitioners has been dismissed, being contrary to law, violative of the principles of natural justice and resulting in denial of a fair and impartial adjudicatory process; b) Issue an appropriate order or direction in the nature of directing that the proceedings bearing HAMA No. 08/2019 titled as
"Lavanya Sagar & Anr.
vs. Anil Sagar", presently pending before the Court of Ld. Family Court, Karkardooma Courts, Delhi, be transferred to any other competent Court of coordinate jurisdiction within Delhi, so as to ensure a fair, impartial and unbiased adjudication of the dispute; c) Direct that the petitioners be granted a fair and meaningful opportunity to lead their evidence in the said proceedings, without being subjected to onerous or prohibitive conditions, and that their evidence be taken on record and adjudicated in accordance with law; d) Pass such further or other orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present This is a digitally signed order. Learned counsel appearing on behalf of the Petitioners, on instructions, seeks leave of this Court to withdraw the present Petitions.
