1. This application has been moved on behalf of applicant- petitioner seeking direction for fixation of place of arbitration at Jaipur in view of the arbitration Clause 19.4 of the agreement.

2. Once an Arbitrator is appointed, it is for the Arbitrator to take a decision with regard to the place where he sits and examines the arbitration application. The venue of arbitration provided under Clause 19.4 would have to be examined by the concerned Arbitrator himself and a decision in this regard will have to be taken by him alone. It is only thereafter the applicant- petitioner may approach this Court.
3. In view of above, the application is disposed of leaving it open for the applicant-petitioner to move appropriate application before the learned Arbitrator at the first instance.
