CORAM:
HON'BLE MR. JUSTICE MANOJ JAIN
J U D G M E N T (oral)
1. The point raised in the present petition is very short and precise one. 2. Petitioner seeks quashing of FIR No. 76/2026 dated 02.03.2026, registered at P.S. Rajinder Nagar, for commission of offences under Sections 74/78(1)/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 354/354D/34 IPC). 3. The quashing is being sought for the reason that there is no allegation against petitioner in the present matter. 4. He also submits that co-accused in the present matter had, already, sought quashing of same FIR and vide order dated 13.05.2026 passed by this Court in CRL.M.C. 3478/2026, this Court has quashed the FIR as well as proceedings emanating from the abovesaid FIR. CRL.M.C. 6014/2026 2
5. While quashing the abovesaid FIR, this Court had observed that the continuation of the FIR against the petitioner would be an exercise in futility and, therefore, the concerned Court is now continuing with the proceedings qua the present petitioner. 6. Learned Senior Counsel for the respondent No.2 i.e. complainant appears on advance notice. 7. Respondent No.2 has joined the proceedings through video conferencing and she has been duly identified by the concerned briefing counsel for respondent No.2 as well as IO. 8. Though, the present petition seeking quashing on the basis of merits, respondent No.2 submits that she would have ‘no objection’ to the quashing of FIR i.e. FIR in toto, since the matter stands settled amicably. She submitted that she has entered into settlement voluntarily, without any coercion, pressure, force or influence from any corner whatsoever. 9. In view of the above, without going deeper into the facts of the case, present petition stands disposed of with the direction that FIR No. 76/2026 is quashed in toto, based on amicable settlement.
Needless to say, since FIR has been quashed, no further proceedings, emanated therefrom, can continue. 10. Pending applications also stand disposed of. (MANOJ JAIN) JUDGE
