Mr. Maidul Islam Kayal, Mr. Noor Ul Amin Sardar, Mr. Archishman Singh, Mr. Sumit Naskar …for the petitioner This is an application wherein petitioner has prayed for a direction for expeditious disposal of the trial in Sessions Case No.169 of 2023 (02 of 2023) presently pending before learned Additional District & Sessions Judge, 2nd Court, Lalbagh, Murshidabad. Learned Counsel for the petitioner submits that the charge under Sections 302/120B/34 of the Indian Penal Code was framed in the Month of December, 2023. It further appears from the order dated 11th February, 2025 passed by a Division Bench of this Court in CRM(DB) 3000/2024 that the prosecution proposes to examine in all 30 witnesses out of which they could examine so far only 11 witnesses and, as such, a direction for expedite hearing of the case is required to be passed since the case is pending before the Trial Court for a considerable period of time. Since the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made therein, the opposite party will have no cause to prejudice, the service of copy of application upon the opposite party is dispensed with. 2 Having heard learned Counsel for the petitioner and that the prayer made by the petitioner is justified in view of above, the instant application being CRR 3936 of 2025 is hereby disposed of with a direction upon the Court below to make his best endeavour to expedite the trial and if possible he will conduct day to day trial without giving any unnecessary adjournment to either of the parties and will make his best effort to conclude the trial preferably within a period of 6 months from the next date of hearing. This order is passed invoking this Court’s jurisdiction under Section 529 of the BNSS.
