This is an application filed under Section 483 of the BNSS, 2023, praying for the grant of bail to the petitioner, namely, Iqbal Hussain, in connection with Moirabari P.S. Case No. 82/2026 under Section 61(2)/319(2)/318(4)/336(3)/340(2)/95/3(5) of the BNS, 2023, read with Section 66(C)/66(D) of the Information and Technology Act. 3. The petitioner was arrested on 01.08.2026 and since then he has been under custody. 4. The learned counsel for the petitioner submits that allegations relating to cyber crimes have been made in the FIR dated 30.07.2026, however, the petitioner herein is not among of the ten named accused persons and he was arrested during investigation soon after the FIR. It is also contended that the petitioner is not involved in the alleged offences and that he has also been implicated due to some political rivalries. 5. The earlier bail application in respect of the present petitioner was rejected vide order dated 02.09.2026 in Bail Appln No. 2548/2026. 6. Similarly situated accused person was granted bail by order dated 17.09.2026 in Bail Appln No. 2795/2026. 7. Considering that the length of detention and the date of the arrest of both Page No.# 3/3 the petitioners are same, and having regard to the above as the period of detention of the present petitioner is 48 days, the prayer for bail is allowed on furnishing a bail bond of Rs. 50,000/- (Rupees Fifty Thousand only) with two sureties of the like amount, subject to the satisfaction of the learned CJM, Morigaon, Assam. 10.
