1. This petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short „the Act‟) for appointment of an arbitrator.
2. The brief facts are that the petitioner-company is engaged in the business of providing crane rental services, heavy lifting and engineered transport for construction industry and related services provided services to the respondent pursuant to Purchase Order („PO‟) dated 20.12.2022 for deployment of a Liebherr LR1800-800 Ton Crawler Crane at Champa, Chattisgarh. Pursuant thereto, the petitioner raised invoices from time to time against which the respondent made part payments leaving an outstanding amount of ₹56,70,712/- along with interest as claimed. Despite repeated requests and assurances the respondent failed to clear the outstanding dues. This is a digitally signed order. 2.1 The arbitration clause contained in the PO provided for resolution of disputes through arbitration by a sole arbitrator. The arbitration clause was invoked at the instance of the petitioner by notice dated 23.12.2025 and proposed the appointment of Shri S.K. Gupta, Ld. District and Sessions Judge (Retd.), as the sole arbitrator. On failure to do the needful, the present petition was filed.
3. The arbitration clause reads as under:-
“20. LAW, DISPUTES & ARBITRATION: i) Any dispute between the Parties arising out of or in connection with the Work Order not settled amicably will be finally settled by arbitration in accordance with „The Arbitration and Conciliation Act, 1996 (as amended from time to time)” by a single arbitrator appointed by Contractor & Purchaser. ii) The venue and place of arbitration shall be at Delhi and the language of arbitration shall be English. The award passed by the aforesaid arbitrator shall be final, binding and conclusive between the parties. iii) Except for provisions to the contrary, the laws of India will be applicable to all agreements, legal actions and factual actions.”

Learned counsel for the respondent on instructions has no serious objection for referring the matter to arbitration.
5. Accordingly, the petition is allowed by appointing Ms. Kaarunya Lakshmi, Advocate (Mobile Nos.8586801514) as the sole arbitrator for adjudication of the disputes which have arisen between the parties.
6. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC). Fee of the Arbitrator shall be fixed as per fee schedule.

with Section 12 of the Act.
8. It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties and it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law.
9. A copy of this order be forwarded to the learned Arbitrator for information.
