Monesh Kumar, for respondent No. 7. 2. In this writ petition, the petitioner is assailing the certificate dated 08.01.2024 issued by Respondent No.1 in favour of Respondent No.5-Trust. 3. Sri. Kashyap N. Naik, learned counsel appearing for the petitioner, submitted that Respondent No.5 had produced certain fraudulent documents before the competent authority while seeking registration of the certificate dated 08.01.2024. On that ground, he sought for quashing of the said certificate. 4. Per contra, Sri. Rakesh Bhat, learned counsel appearing for Respondent No.5, invited the attention of the Court to the memo dated 31.01.2026 and submitted that the dispute between the petitioner and Respondent No.5-Trust has already been resolved in A.C. No.299 of 2023 before the learned Arbitral Tribunal on 04.07.2025. - 5 - HC-KAR NC: 2026:KHC:14228 WP No. 4178 of 2024 He further submitted that, in view of the said settlement, the present writ petition does not survive for consideration and therefore, sought dismissal of the writ petition. 5. Having taken note of the submissions made by the learned counsel for the parties, the grievance of the petitioner pertains to the permission granted to Respondent No.5-Trust to run the Institution. It is not in dispute that the rival claims between the petitioner and Respondent No.5 have been settled by the learned Arbitrator in A.C. No.299 of 2023 by an award dated 04.07.2025, wherein Clause F(iii) in the Settlement Award before the learned Arbitrator, provides that the parties shall withdraw all pending cases against each other before the courts of law. 6. In that view of the matter, since the rival claims between the petitioner and Respondent No.5 have been resolved by way of arbitration proceedings in A.C. No.299 of 2023, this Court is of the opinion that if any grievance - 6 - HC-KAR NC: 2026:KHC:14228 WP No. 4178 of 2024 still survives, as raised by the petitioner in the representations at Annexure–D series, the same requires to be considered by Respondent No.1 in accordance with law. 7. Accordingly, Respondent No.1 is directed to consider the representations submitted by the petitioner at Annexure–D series and pass appropriate orders in accordance with law within an outer limit of three months from the date of receipt of a certified copy of this order.
