The petitioner, through the medium of present petition is challenging
order dated 13.10.2025 passed by respondent No. 5 whereby SSP Crime Branch Kashmir has been asked to register FIR against the petitioner for investigating the issue with regard to the fake date of birth of the petitioner.
The issue involved in the present writ petition qualifies to be a
“Service Matter” within the definition of Section 2(q) of the Administrative Tribunals Act.
Learned counsel for the petitioner has submitted that the petitioner has superannuated from services and therefore, the matter is not amenable to the jurisdiction of Central Administrative Tribunal. I am afraid that the submission made by the learned counsel for the petitioner is misconceived because even service matter of a pensioner is also amenable to the jurisdiction of Central Administrative Tribunal.
In view of the above, the writ petition is dismissed leaving it open to the petitioner to approach the Central Administrative Tribunal, Srinagar.
