HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 5512/2026 CNR: RJHC020246222026 | URN: CW / 12147U / 2026 Ms. Neha Khandelwal D/o Shri Rakesh Mohan Khandelwal ----Petitioner Versus Jaipur Hospital College Of Physiotherapy ----Respondent For Petitioner(s) : Ms. Jaya P. Pathak Mr. Arnav Singh, Mr. Dhairya Agarwal Mr. Shashwat Sharma For Respondent(s) : Mr. Shovit Jhajharia Mr. Yash Joshi (through VC) Mr. Deepak Mittal HON'BLE MR. JUSTICE MANEESH SHARMA Order 08/09/2026 1. The matter has come up on an application (IA No.1/2026) filed by the applicant/petitioner seeking a direction to the respondents to permit the petitioner to provisionally appear in the examination. 2. Learned counsel for the petitioner submits that, despite the order dated 06.04.2026 passed by a Co-ordinate Bench of this Court, which continues to operate and whereby the applicant was permitted to continue the BPT course at the respondent-College, the respondent No.2 is not permitting the petitioner to fill in the examination form and appear in the ensuing examination. 3. Learned counsel for the respondent-University seeks time to take updated instructions. 4. Heard. (2 of 2) [CW-5512/2026] 5. Considering the earlier interim order as well as the fact that the last date for filling in the examination form with double exam fee is 10.09.2026 and the examination is scheduled to commence on 25.09.2026, the respondent No.2 is directed to permit the petitioner to fill in the examination form and appear provisionally in the BPT examination pursuant to the notification dated 21.08.2026 (Annexure A/1). 6. It is made clear that the aforesaid interim order/direction shall not create any equity in favour of the petitioner. The result of the petitioner shall not be declared without the leave of this Court. 7. Accordingly, the application (I.A. No. 1/2026) stands allowed. (MANEESH SHARMA),J Deepa-93
