1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 106/2026 registered at Police Station Shyam Nagar, District Jaipur City (South) for the offences under Sections 318(4), 61(2) of BNS.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. The first bail application of the petitioner was dismissed by this Court vide order dated 12.05.2026 on merits, thereafter, the charges were framed against the accused-petitioner and trial was commenced. The trial Court has recorded the statement of one witness out of 13 cited witnesses. The petitioner is in custody for about more than 6 months. The other similarly placed co-accused
[2026:RJ-JP:36634] (2 of 2) [CRLMB-10722/2026] Jitendra Singh and Chaman Singh have already been enlarged on bail. The matter is exclusively triable by Magistrate. Apart from a matrimonial case is registered under Section 498-a of the IPC and there is no other criminal antecedent against the accused- petitioner, therefore, considering the long incarceration of the petitioner, the second bail application of the petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the material available on record.

Without commenting anything on the merits of the case and looking to the fact that the petitioner is in custody since long and further trial of the case may take considerable time and the matter is exclusively triable by Magistrate, this Court deems it proper to enlarge the accused-petitioner on bail.

Accordingly, this second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Avinash Sharma S/o Ramakant Sharma, in connection with FIR No. 106/2026 registered at Police Station Shyam Nagar, District Jaipur City (South), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
