Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon’ble Court may kindly be pleased to allow the writ petition and may kindly be pleased to issue a writ of mandamus, directing the respondents to create the posts of mechanic sewing machine in the service rule of 2005 or may treat the petitioner as working on the post Kushal Sahayak or other equal post and thereafter grant him promotion in accordance with law. 10.2 That, this Hon’ble Court may kindly be call for the records for its perusal which relates to petitioner’s matter. Learned counsel for the petitioner submits that the petitioner is working since long on the post of Mechanic (Sewing) Machine (Trade CDDM). After completion of the requisite period of service, he became eligible for his promotion. However, in the post set-up of the college in which the petitioner is working, there is no post of Mechanic (Sewing) Machine and therefore, he is being paid from other heads. He contended that unless and until the post of Mechanic (Sewing) Machine is crated in the post set- up of the college, the petitioner will not be entitled for promotion on the higher posts. Petitioner submitted representation before the authorities, however, the same has not been considered and decided till date. 3. He also contended that in the facts of the case, where it is for the State Government to consider the grievance of the petitioner and to create post of Mechanic (Sewing) Machine, petitioner may be permitted to submit a fresh representation before Respondents No. 1 & 2 raising all the grievances as raised in this petition as also other grievances of the petitioner and the Respondents No. 1 & 2 be directed to consider and take decision on the representation to be submitted by the petitioner in accordance with law at the earliest. 4. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to submit representation before the concerned authority, she is having no objection to the limited prayer. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised 3 / 3 by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit afresh representation before the Respondents No. 1 & 2 along with other supporting documents and if such a representation is submitted by the petitioner, the Respondents No. 1 & 2 shall consider and take decision on the representation to be submitted by the petitioner in an objective manner, expeditiously, preferably within a period of 06 months from the date of receipt of representation. 7.
