Petitioner has filed this writ petition under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, the impugned order of the promotion (Annexure P-1) be quashed and set aside for Non-Compliance of rules. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent no 2 and 3 to hold review departmental Promotion Committee and consider the petitioner for promotion in accordance with law to ensure fairness and transparency. 10.3 Any other relief, which may be deemed fit and proper in the facts and circumstances of the case, may also be allowed.” 2. Learned counsel for petitioner submits that petitioner is holding the post of ‘peon’ and she is eligible for promotion on the post of Assistant Grade-III. Respondent authorities have initiated the proceedings for promoting Class-IV employees to Assistant Grade-III. However, juniors to the petitioner have been promoted superseding the petitioner. Petitioner thereafter has submitted a representation before respondent No.3 on 28.08.2025, which till date is pending consideration and, therefore, direction be issued to respondent no. 3 to consider and take decision on pending representation at the earliest. 3. Learned State counsel submits that, in view of the limited prayer made by learned counsel for petitioner, he has no objection. 4. On due consideration of submission made by learned counsel for the respective parties, this writ petition at this stage is disposed of directing respondent No.3 to take decision on the representation submitted by the petitioner, in accordance with law, at the earliest, preferably within a period of 08 weeks from the date of receipt of a copy of this order. 3 Petitioner will be at liberty to submit a fresh representation, if she so desires, and if such representation is submitted, the concerned authority shall consider the representation to be submitted by petitioner along with the pending representation. 5. With the aforesaid observation and direction, this writ petition stands disposed of. 6. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
