The petitioner is an accused in connection with Barwadda PS Case No. 297/2025. It has been alleged that when the villagers had protested the act of some unknown persons in erecting a boundary wall, the petitioner had threatened the villagers brandishing a pistol. The other accused persons had also demanded extortion money. After some time, the accused persons had abducted the son and grandson of the brother of the informant but later on they were released. Submission has been advanced by the learned counsel for the petitioner that the case has been instituted as a fallout of a civil dispute. Learned counsel has copiously referred to the supplementary affidavit filed by the petitioner, in which, various documents have been brought on record related to the land in which the incident had taken place. It has been submitted that several co-accused persons named in the First Information Report have been granted anticipatory bail by the learned Court-below. Learned counsel submits that the petitioner is in custody since 25.12.2025. Learned A.P.P. as well as learned counsel for the informant have opposed the prayer for bail of the petitioner. Learned counsel for the informant has submitted that none of the documents indicate that the petitioner even had a claim over the disputed site. It has further been submitted that the petitioner had a pistol in his hand which he brandished in order to threaten the villagers and in fact, the petitioner has got six criminal antecedents, some of which relate to extortion and which clearly reveal that the petitioner is a habitual offender. A colour has been given with respect to a civil dispute existing between the parties and the First Information Report was a resultant effect of such dispute. It also appears that several of the co-accused persons had sword, lathi and other weapons in their hands and so far as the petitioner is concerned, he was said to be having a pistol, which he brandished in order to threaten the villagers. On consideration of the fact that some of the co-accused persons named in the First Information Report have been granted anticipatory bail, I am inclined to grant bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.
