In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Raiganj Police Station case no. 379 of 2009 dated 18.11.2009 under Sections 302/364/201/120B/34 of the Indian Penal Code and 25/27 of the Arms Act.
And In the matter of : Biky Saha @ Biki Saha @ Viki Saha.
……Petitioner. Ms. Minoti Gomes Mr. Jisan Iqubal Hossain
.....for the Petitioner Mr. Soumik Ganguly Mr. Subhajit Chowdhury
……for the State. Mr. Sourav Chatterjee Mr. Soumya Nag Ms. Namrata Chatterjee
.....for the de-facto complainant.
Learned advocate appearing for the petitioner submits that petitioner is in custody for about 13 years and till date trial has not been concluded. Learned advocate for the State submits that because of different tactics adopted by the accused the trial could not proceed smoothly. However, presently the case is at the final stages wherein one witness which is one of the investigating officer of the case is required to be examined. Having considered the advance stage of the case and initially all the accused were not available as such the Court could not proceed, I am not inclined to release the petitioner bail at this stage.
2 Accordingly, the prayer for bail of the petitioner in CRM (M) 649 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
